That letter to US federal employees encouraging them to quit may be illegal.

Per the Anti-Deficiency Act, “no officer or employee of the Government may create or authorize an obligation in excess of the funds available, or in advance of appropriations unless otherwise authorized by law."

Furthermore, OPM “lacks the authority to promise paid leave for government employees other than its own.”

CONGRESS has to appropriate funds (by March 14 or the gov’t will shut down).

Also-

It is against ethics rules for federal employees to obtain a second job in the private sector w/o strict approval (because of conflict of interest and security concerns).

The letter encourages them to get another job in the private sector, seemingly while still on deferred leave.

And again, there is absolutely no guarantee whatsoever that those employees would be paid if they resign.
