That's not necessary CinC discretion; it's arbitrary discrimination. And unconstitutional.

@three_star_dave You do understand the 3 branches of government, right? An non-elected Fed judge, who, go figure in a donor to the left , can't tell the executive how he can run the military, he's the commander of the military. The military is not a social experiment for "what" I feel I am, but there for two things, blow things up and kill the enemy. Simple as that
