Ruling in the climate case Saul Lliuya (farmer in Peru) vs German coal major RWE got moved from April 14 to May 28 following a "challenge on grounds of bias" (Befangenheitsantrag) by Lliuya against the court-appointed geologist expert Katzenbach! justiz.nrw/presse/2025-04-09

Who made the court hire this shitty guy in the first place, eh? RWE ?? I can't trust these judges!
RWE is such a villain!
It is well known from past activists' engagements that RWE owns the police in the state North Rhine-Westphalian and are directly responsible for a reporter's fall to death during the dismantling of the tree house village in #HambiBleibt by the police.
So it is utterly conceivable that RWE owns the district court OLG Hamm as well!!

The web quotes a sentence Katzenbach said in court: "The damages to Lliuya's property would be ridiculously low."

Some more ( but not all I read ) of this "expert's" statements in this long thread directly from the court room. Scroll up and down... bsky.app/profile/duycks.bsky.s

I don't know how such a long thread displays if you're not logged in. So I chose to link to a posting near the end of a thread. Hope it's working out alright.

Bluesky Social · 🌍⚖️ Sébastien Duyck (@duycks.bsky.social)54/ We are now turning to RWE's closing statement. "This is a litigation for the public" 🤔a curious argument for a defendant that was reminded BY THE PRESIDING JUDGE to stop fearmongering & bad faith in its public discourse in relation to the ongoing trial.

Important court day. A farmer from Peru is suing German coal major RWE for contributing to climate change which is bound to cause a rockslide into the glacial lake uphill from the farner's honetown.. and drown them all... unless an expensive protection dam is built. The cost of which RWE shall have to pay.
The verdict by the first instance court in 2017 denied the argument.
Today's court, Oberlandesgericht Hamm, starts from scratch. The judges even did an onsite visit in 2022 as preparation.
And they appointed a court expert on specific climate attribution, too...who, it turns out, is on the side of RWE... See the second to last post in below thread...

Here's a live ticker from the court room. This is the last post in the thread:

Next court day is Wednesday.

Bluesky Social · 🌍⚖️ Sébastien Duyck (@duycks.bsky.social)30/ 👋 And it's a wrap for today! Judge Meyer suspends the hearing - the expert's cross-examination will continue on Wed. 🔎 I will share shortly on this platform a brief recap of today's highlights: while today's hearing was quite technical, some key lessons can already be drawn.

Climate activist Mike Smith’s Smith vs Fonterra legal case fails in the Court of Appeal but the door is left ajar for future claims against Govt decisions.

‘Ambitious’ climate claim against Attorney-General dismissed newsroom.co.nz/2024/12/24/ambi

Newsroom · ‘Ambitious’ climate claim against Attorney-General dismissedBy David Williams

Our Children's Trust:

Today, Wednesday 18th December 2024, the highest court of Montana agreed: Children have fundamental rights to a safe and liveable climate!

16 Montana youth held their government accountable for harming their fundamental rights to health, safety, liberty, dignity, equal protection of the law, and a clean and healthful #environment. Our youth clients’ voices were heard. The Montana Supreme Court has upheld science-based protections for a safe and healthy #climate, affirming that fossil fuel pollution is incompatible with children’s constitutional rights and that an environmental life support system includes a stable climate system.

This was a resounding 6:1 victory!

This landmark decision is now firmly embedded in Montana’s constitutional law, ensuring that no politician can revoke these protections, today or in the future.
