Attacking Direct Democracy
americanoversight.org/newslett

* citizen-led initiatives protecting reproductive rights under attack
* across U.S. right-wing officials/interest groups opposed to will of people changing the rules
* even when voters try to protect abortion rights through ballot initiatives, attacks continue: courts/legislative capturesubversion)

After gutting the Better Boundaries initiative and having the Utah Supreme Court tell them that wasn’t okay, the Utah Legislature is now asking voters for permission to gut Better Boundaries or any other initiative.

They can wring their hands and clutch their pearls all day long about the dangers of having “super-laws” but the fact is that citizen initiatives are probably the hardest way to pass extreme legislation. Better Boundaries wasn’t extreme (except that it was extremely inconvenient for the GOP majority in the legislature) but the legislature is just using the spectre of extreme initiatives to try to convince us that they should be allowed to override (not simply clarify or amend) the will expressed by the voters at the ballot box.

This is a case study in why it is dangerous to have a single party consistently dominating the politics of the state.

Rep. Jordan Teuscher, R-South Jordan, speaks in the House as Utah’s legislature holds a special session to consider an initiative constitutional amendment at the Capitol in Salt Lake City on Wednesday, Aug. 21, 2024.
Deseret News · Constitutional amendment will now go to Utah votersBy Hanna Seariac

The #MichiganSupremeCourt ruled 4-3 the state #Legislature lacked the authority to
#AdoptandAmend petition language for a pair of #BallotInitiatives in 2018. Justices said the tactic is unconstitutional because the Legislature circumvented the petition initiative process in 2018. Increases to #Michigan's standard minimum wage, tipped #MinimumWage & an expansion of the state's earned sick time laws are slated to take effect in February.

Detroit Free Press · Michigan Supreme Court strikes down 'adopt and amend,' setting up increase to minimum wageBy , Detroit Free Press

Never forget that ever since the fall of #roe, #abortion has been expanded at every chance the #people are given to weigh in directly.

Every time it has been restricted, it is by unelected or unaccountable #Christofascists bringing back laws from the literal 1860s.

If a #nationalban happens, it will be because of #comstock_act rules, and it will be done by people actively hiding their motives to do so. #liberals cannot be trusted to act as a bulwark in this, but #ballotinitiatives are a place to start.

I'm sure that in at least some of the states who have yet to petition to keep him off the ballot, they have been taking a "wait and see" approach-- "wait and see if he gets the nomination" and "wait and see what the #SupremeCourt says on the existing cases."

But EVERY state needs to file such petitions ASAP, get him off in as many states as possible before the #GeneralElection ballots are printed up, and push #SCOTUS to make a decision on the subject long before the general election.

“As pro-choice ballot initiatives keep winning, Republican-dominated legislatures across the country are trying to make it harder for citizens to use ballot initiatives. Republican attempts to stop voters from challenging their policies … will echo beyond the issue of abortion to any policy voters would like to challenge.”
