On Verdict in #GreenpeaceUSA Trial:

"It is our collective assessment that the jury verdict against Greenpeace in #NorthDakota reflects a deeply flawed trial with multiple due process violations that denied Greenpeace the ability to present anything close to a full defense. Attorneys on our team monitored every minute of the proceedings and found multiple violations of #DueProcess that denied Greenpeace its right to a fair trial. The problems included a jury that was patently biased in favor of #EnergyTransfer, with many members working in the #FossilFuel industry; a judge who lacked the requisite experience and legal knowledge to rule properly on the complex #FirstAmendment and other evidentiary issues at the center of the case; and incendiary and prejudicial statements by lawyers for Energy Transfer that tried to criminalize Greenpeace and by extension the entire #ClimateMovement by attacking constitutionally-protected advocacy.

"Our fear that this was an illegitimate #corporate-funded #SLAPP harassment case was confirmed by our observations.

"We will be issuing a full report documenting these violations and larger flaws in the case in the coming weeks.

"While the trial court verdict is in, the case is far from over. Greenpeace has a right to appeal to the North Dakota Supreme Court and ultimately to the #USSupremeCourt. Our committee will continue its work monitoring this critically important case that raises troubling concerns for all advocates in the country."

"A jury in #NorthDakota has ordered Greenpeace to pay more than $660 million in damages for defaming #EnergyTransferPartners, the corporation behind the Dakota Access Pipeline. The Texas-based pipeline company accused Greenpeace of orchestrating criminal behavior by training and providing funds to the #Indigenous-led protests at #StandingRock. Greenpeace and its supporters, including other #nonprofits and #advocacy groups, argued that the lawsuit is part of a conspicuous attempt by #corporations to destroy the right to #FreeSpeech. Longtime #HumanRights and #environmental lawyer #StevenDonziger, who was part of the independent trial monitoring team observing the trial, says it was purposely held in a region of the country with deep ties to the #FossilFuel industry. Donziger said most of the jurors in the case were connected to the industry and were 'predisposed' to rule in favor of Energy Transfer despite the 'false narratives' presented at the trial. Greenpeace plans to appeal the ruling."

She highlights the close links between North Dakota’s government and Energy Transfer and says that while the lawsuit targets Greenpeace, Indigenous water and land defenders are also on trial. Donziger sued Chevron on behalf of farmers and Indigenous peoples who suffered the adverse health effects of oil drilling in the #EcuadorianAmazon. 'I visited Ecuador. I saw what Chevron did. It is disgusting' and 'grotesque,' says McGovern. 'Donziger stood up for these people who had no voice.' In return, Chevron has spent millions prosecuting him instead of holding itself to account, he adds, while a pardon from the president would show that the system can still 'stand up to #CorporateGreed and excesses.'"

"This comes as Israel’s former Defense Minister Moshe 'Bogie' Ya’alon has accused Israel of ethnic cleansing and committing war crimes in Gaza. Ya’alon, who served as Netanyahu’s defense minister from 2013 to 2016, made the accusations several times over the weekend, including in an interview on one of Israel’s biggest television channels.

"Moshe Ya’alon: “To occupy, to annex, to cleanse, ethnic cleansing, look at the northern Gaza Strip and settle a Jewish settlement. That’s the point. There is no Beit Lahia. There is no Beit Hanoun. They are operating in Jabaliya and are essentially clearing the area of Arabs.'"

"AMY GOODMAN: That’s Dr. Ahmed al-Kahlout, who was killed this weekend, head of Kamal Adwan’s intensive care unit. Hani?

HANI ALMADHOUN: Yes, rest in peace, Dr. Ahmed al-Kahlout. He’s a friend of the family. He’s our neighbor. He was killed exactly a day before Mahmoud. In fact, he gave my — he was able to give my brother painkillers, because my dad, who’s 72 years old, was hurt two weeks ago by Israeli quadcopter, and we couldn’t find painkillers. The doctor said he didn’t want anything. He asked if Mahmoud can do him a favor and get him tomato paste. Can you imagine this hero saving lives and can’t find tomato paste? And Mahmoud said, “I’ll find it for you.” And he went to the hospital, and boom, that day, the guy was assassinated. He’s the head of the intensive care unit.

Mahmoud has developed a friendship with Dr. Hussam Abu Safiya, the hero doctor, solving problems for him. In fact, 10 days before Mahmoud’s assassination, he delivered filtered water for the hospital for their dialysis unit. Can you imagine a civilian figuring out how to deliver filtered water for the hospital, not just for drinking, but also to run the dialysis unit? You can’t imagine how important Mahmoud was for the hospital. The hospital already sent their condolences. They’re worried about lack of his support. In fact, yesterday the shipment of produce that Mahmoud ordered just got to the hospital. You know, they are out of fresh food. They’re eating pasta and rice that’s delivered by UNRWA and the World Health Organization.

But yesterday I was in a conference call with Dr. Hussam, and he said, “Out of the 50 items we need, these organizations are able to deliver six or seven,” and he’s frustrated because he’s not getting the help he needs. And, you know, I’ve met the doctors. They’re not seasoned by any measure. They’re just fresh out of medical school, trying their best, doing things that — even nurses in Gaza are doing operations now, because there’s nobody else to do these things. And it’s unfortunate we continue to do this.

And the cruelty, Amy, my brother survived this genocide for 420 days, and then he’s killed. And he was telling me the day before, “Hani, there might be good news. They’re talking about a ceasefire.” It’s one thing to be killed early in the war and not suffer as much, but he was killed toward, I hope, to be the tail end of it.

He does not deserve to be killed. And I inquire and I challenge the Israelis to publicly say why they targeted my brother. We have full confidence that he is the person we know. He’s a civilian dad who wanted to help his neighbors, and everybody knows him and supported him, and we pray for him.

But also, we want to make sure people there, you know, they can still do things. You know, why are they banning UNRWA? Why is the U.S. defunding the U.N. agency? This is no longer about October 7th and the horrors. This is about ethnically cleansing north of Gaza. The south is also facing starvations. We run a soup kitchen there. And we went from a $1,000 budget to $5,000 daily budget just to get people some rice, because food is not available. But we want to respond. Despite our pain, my cousins and nephews and sister-in-law is cooking for people in four out of the five soup kitchens we continue to run. We’re not going to close, because this is our family, this is our commitment. We don’t cook for people, we don’t eat ourselves.

This is not — and this is risky. You know, it should not be risky. It should not be an heroic act to get water to the hospital. And that’s why I remember the 230 UNRWA staff who were killed, and not just UNRWA. You’ve mentioned the Save the Children. You’ve mentioned other organizations who have lost their staff. And —

AMY GOODMAN: World Central Kitchen.

HANI ALMADHOUN: Yes, correct. And unfortunately that sometimes, you know, Israeli accusations run in the media as a fact, and that’s — nobody challenges whatever allegations are made, because, “OK, it’s good enough for me.” Nobody’s going to push back. And in the case of my brother, we’re pushing back as much as we can.

AMY GOODMAN: Finally, of course, you are not the only one who’s accusing Israel of ethnic cleansing. Israel’s former Defense Minister Moshe Ya’alon has accused Israel of ethnic cleansing and committing war crimes in Gaza. He served as Netanyahu’s defense minister from 2013 to '16, made the accusations several times over television, including on one of Israel's biggest TV channels. This is what he said, and we’re going to end with your comment after this.

This is the price to pay for standing where we were raised. This is the memory of the Nakba. We learned our lesson from our grandparents who were ethnically cleansed. And now we refuse to do the same. But unfortunately, when they kill so many of our family members, our family relocated still in north Gaza, standing by, hoping that somebody watching, somebody listening, somebody from our government will definitely develop a conscience and try to save our people. This is no longer a war against terror. This is a war against the civilians in Palestine, including Gaza. Thank you so much."

"Israel killed more than 200 Palestinians in Gaza on Saturday, including 40 members of a single family. The official death toll in Gaza is now over 44,000, although experts believe that is a vast undercount of the true figure. Israel’s onslaught has continued to kill medical and aid workers in recent days, including three people with World Central Kitchen, the head of the intensive care unit at Kamal Adwan Hospital, a staff member with Save the Children, as well as Mahmoud Almadhoun, who co-founded the Gaza Soup Kitchen that has fed Palestinians suffering hunger due to Israel’s blockade of vital food aid. Almadhoun was killed in an Israeli drone strike and is survived by seven children, including a newborn baby. His brother Hani Almadhoun joins Democracy Now! to discuss what he calls a targeted assassination. 'My brother slowed down the ethnic cleansing of north Gaza, and that’s why he was taken out,' says Almadhoun. 'This is a war against the civilians in Palestine.'"

"In Part 2 of our special broadcast, we look at a recent victory for Indigenous communities in Ecuador, where people overwhelmingly voted to approve a referendum last year banning future oil extraction in a biodiverse section of the Amazon’s Yasuní National Park — a historic referendum result that will protect Indigenous Yasuní land from development. But the newly elected president, Daniel Noboa, has said Ecuador is at war with gang violence and that the country is 'not in the same situation as two years ago.' Noboa has said oil from the Yasuní National Park could help fund that war against drug cartels. Environmental activists and Indigenous peoples say they’re concerned about his comments because their victory had been hailed as an example of how to use the democratic process to leave fossil fuels in the ground. 'Amazonian women are at the frontlines of defense,' says Nemonte Nenquimo, an award-winning Waorani leader in the Ecuadorian Amazon who co-founded Amazon Frontlines and the Ceibo Alliance. Her recent piece for The Guardian is headlined 'Ecuador’s president won’t give up on oil drilling in the Amazon. We plan to stop him — again.' Nemonte has just published her new memoir titled We Will Be Jaguars: A Memoir of My People. "The House of Representatives passed a bill Thursday that would empower the Treasury Department to revoke the tax-exempt status of any nonprofit it deems has provided material support to a terrorist organization. A broad coalition of civil society groups have opposed the bill, warning that it would give the Trump administration sweeping powers to crack down on political opponents. H.R. 9495, the Stop Terror-Financing and Tax Penalties on American Hostages Act, passed the House 219 to 184 largely along party lines, with 15 Democrats supporting the Republican majority.

"'This bill is essentially a civil rights disaster,' says Darryl Li, an anthropologist, lawyer and legal scholar teaching at the University of Chicago. Li, who recently wrote a briefing paper on the anti-Palestinian origins of U.S. terrorism law, says 'anti-Palestinian racism is one of the great bipartisan unifiers in Congress.'"

"In northern Gaza, at least 93 Palestinians, including children, were killed today when an Israeli airstrike leveled a five-story apartment building sheltering displaced families in Beit Lahia. Dozens of wounded people were rushed to the #KamalAdwanHospital only to be denied care. Just one doctor and a few exhausted medical workers remain at the hospital after Israeli forces in recent days raided the facility, separated men and women, and arrested much of the remaining staff and patients. U.N. #HumanRights Chief Volker Türk has called Israel’s ongoing siege on northern Gaza the 'darkest moment' of the conflict."

"Two-time Academy Award nominee Marshall Curry presents A Night at The Garden, a film that revisits a night in February 1939 when '20,000 Americans rallied in New York’s Madison Square Garden to celebrate the rise of Nazism — an event largely forgotten from U.S. history.' As we described it back in 2017, the film documents the following scene:

"What you’re looking at is the 1939 'Pro-American Rally' (aka Pro-Nazi Rally) sponsored by the German American Bund at Madison Square Garden on George Washington’s 207th Birthday. Banners emblazoned with such slogans as 'Stop Jewish Domination of Christian Americans,” 'Wake Up America. Smash Jewish Communism,' and '1,000,000 Bund Members by 1940' decorated the great hall.

"New York City Mayor Fiorello LaGuardia—an Episcopalian with a Jewish mother—considered canceling the event, but ultimately he, along with the American Jewish Committee and the American Civil Liberties Committee [#ACLU] decreed that the Bund was exercising its right to free speech and free assembly.

"A crowd of 20,000 filled the famous sports venue in mid-town Manhattan to capacity. 1,500 police officers were present to render the Garden 'a fortress impregnable to anti-Nazis.” An estimated 100,000 counter-demonstrators were gathering outside.…'"
