The Court was correct in its determination that "may issue" is a gross violation of the #RTKBA, but constitutional interpretation (what the law as written and enacted means) and construction (what the law requires of us that is not written) are two very different things.

The mere fact that analogous laws did not exist in the history and tradition does not in and of itself preclude validity or #constitutionality. To suggest otherwise would render all subsequent acts of Congress null and void.

— These laws were #unconstitutional, and they knew it when they #sponsored and #voted for it. They count on the lag time between a law being #passed, and the #resolution of a #court #challenge.

I would also support requiring a pre-clearing process kinda of like the #CBO #budgetscores, but for the #constitutionality of the proposed law, that would stop this. If the law is not certified in advance, it cannot ever enter the legislative process. This would apply to state and federal laws.

As for any challenge to the #constitutionality of the provision, the bill gave the DC #FederalCourts exclusive power to rule on any #constitutional challenge.

Citing that #law, lawyers for the #pipeline asked the #SupremeCourt to vacate the lower court order & direct dismissal of the litigation. They argued that under the new law, the 4th Circuit Court of Appeals no longer has the power to hear the case. The federal gov weighed in as well, supporting the pipeline's #legal position.
