Wow! Any attorneys here know if trump trying to pay off Stormy Daniels AGAIN to not talk about the $627,000 she just had to pay him for defamation is another campaign finance crime?
@DebR not if they report it
@blueemu I’m not talking about that judgment. She had to pay it. I’m talking about trump insisting she sign an NDA not to talk about it or him before the election.
@DebR No, I was saying that if they report their hush money payments to the FEC, then there's no crime. There's no law against paying someone hush money, but if you do it to influence an election, it has to be reported as campaign spending (thus defeating the purpose).
Apologies for reply-guying, I know you asked for lawyers originally.
@blueemu The point is not that she paid the money to him that she owed. The point is that he tried to make her sign an NDA that would silence her from talking about him at all. She would not even be able to mention his name, and she flipped him the bird.
@DebR Yes I know, that's what I'm talking about, not what they are making her pay, what they originally paid to her and what they offered to pay again. They being Trump's people. What Michael Cohen went to jail for and what Trump was convicted for was because they didn't report their hush money payment to the FEC. That made it a campaign finance violation.
So if they had actually paid her again, then did not report that to the FEC, that would have been the same crime.
@DebR but it never got that far because, as you say, she gave the letter they sent to the media and gave them the bird. Hilarious.
@blueemu They aren’t paying her. She had to pay them for defamation.
@DebR You asked if they had committed another campaign finance violation.
The first campaign finance violation they committed was not reporting the hush money paid to Stormy Daniels as campaign spending.
Now they have offered to give her a discount on the defamation judgment she owes them (the $627k you mentioned) in exchange for her signing another NDA. I assume this is the second violation you asked about, but it would only be a crime if they didn't report it to the FEC.
Discharging a...
@DebR debt is considered the same as paying someone, so if she had signed their new NDA and they didn't report that to the FEC it would be a crime. If they did report it, there's no crime.
That's what my original response meant.
